18.05.2021 sdas allowed C.R.M. No. 1100 of 2021 (via video conference) In Re.: An application under Section 438 of the Code of Criminal Procedure in connection with Ashok Nagar Police Station Case No. 23 of 2021 dated 11.01.2021 under Sections 448/354A/323/379/506/34 of the Indian Penal Code.

And In Re: Nitai Sutradhar & Ors. ......... petitioners Mr. Subhojit Chowdhury ...for the petitioners Mr. Saibal Bapuli, learned APP Mr. Arijit Ganguly Mr. Sanjib Kumar Dan .... for the State Considering the materials on record and after hearing the learned Counsel appearing for the parties, we are of the opinion that having regard to the nature and extent of involvement of the petitioners in the commission of the alleged offence, custodial interrogation of the petitioners may not be required.

Accordingly, we direct that in the event of arrest the petitioners namely Nitai Sutradhar, Gayetri Sutrodhar, Pallabee Sutradhar @ Pallabee Bose Sutradhar and Bidhan Saha shall be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of like amount each, to

the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.

Petitioners no. 1 and 4 i.e. Nitai Sutradhar and Bidhan Saha respectively shall meet the investigating officer once in a week until further orders. All the petitioners shall co-operate with the investigating officer.

With the aforesaid observations, this application for anticipatory bail is, thus, allowed.
