For the State Ms. Nibedita Pal ........... for intervenor The petitioner happens to be one of the heirs of a Court No. 24 15.03.2022 (Item No. 83) (AB) deceased M.R. dealer. He is interested to continue the business. He made an application for being engaged on compassionate ground.

The Sub-Divisional Controller Food and Supplies, Jhalda, Purulia by a communication dated 28th January, 2022 directed the petitioner to submit the required documents within seven days from the date of issuance of the letter failing which the authority will take steps for declaring the vacancy.

The petitioner on 31st January, 2022 made a representation before the said authority seeking extension of time for filing the said documents. The representation is yet to be considered.

The instant writ petition is disposed of by directing the Sub-Divisional Controller, Food and Supplies, Jhalda, Purulia to take steps for consideration of the representation filed by the petitioner on 31st January, 2022 strictly in accordance with law, at the earliest, but

positively within a period of eight weeks from the date of communication of a copy of this order.

The said respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter. The said respondent, if required, shall afford an opportunity of hearing to all the necessary parties prior to taking a decision in the matter.

Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
