It appears from record annexed to this writ petition that against the grievance raised in this writ petition, petitioner has already made a representation before the respondent Commissioner of Commercial Taxes/respondent no.2 on 19th December, 2023. Details of such grievance will appear from the said representation.

Considering the facts and circumstances of the case and submission of the parties, this writ petition being WPA 2378 of 2024 is disposed of by directing the respondent no.2 to consider and dispose of the

representation of the petitioner in accordance with law and by passing a reasoned and speaking order after giving opportunity of hearing to the petitioner or its authorized representatives and particularly by taking into consideration the judgment of this Court dated 6th December, 2021 (Tata Steel Limited & Anr. Vs. State of West Bengal & Ors.) and in course of hearing if it is found that the case of the petitioner is similar to Tata Steel Limited (supra), petitioner shall be given all consequential benefits.
