W.P.A. 2296 of 2022 (Kutubuddin Sekh vs. State of West Bengal & Ors.) Mohiur Sasmal Hasanuz Zaman .... For the Petitioner Mr. Soumitra Bandyopadhyay Mr. Ram Chandra Guchhait .... For the State The petitioner complains encroachment of his plot by the respondent Authorities for widening of Kolkata-Basanti Road (SH3A). The petitioner submitted a representation before the concerned Authority ventilating his grievance on 23rd March, 2021 and has prayed for a direction upon the Authority to consider the said representation.

Learned counsel for the State respondents submits a report in this regard which demonstrates that the road widening work has been suspended and proposal for direct purchase of the required land to facilitate such road widening work has been forwarded to the District Magistrate and Collector, South 24 Parganas by the Deputy Secretary, PWD (Road

Wing) on 13th January, 2022. The report further indicates that status quo has been maintained in front of the petitioner's plot and the PWD shall not take up any road construction activity beyond the Government land boundary. In the premises, it is held that the representation submitted by the petitioner has been acted upon by the Authority.

Nothing further remains for adjudication in this writ petition.

Accordingly, W.P.A. 2296 of 2022 is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
