Learned advocate appearing for the petitioner submits that petitioner was arrested on 06.05.2019 and since then he is in custody for more than six years eleven months. Learned advocate for the State on the other hand opposes the prayer for bail and submits that there are materials appearing against the present petitioner and according to the witnesses there was a dispute between the couple which resulted in the unfortunate incident resulting in the death of the deceased/victim. Records reflect that out of 15 witnesses cited by the prosecution three witnesses have been examined till date. Having considered the same and taking into account that there is less possibility of the trial being concluded very soon and without entering into the merits of the case, I am inclined to release

the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed.

Accordingly, petitioner namely, Prasanta Kumar Bagdi shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Sessions Judge, 1st Court, Durgapur. If on bail, the petitioner shall be physically present before the learned trial Court on each and every date and shall not leave the jurisdiction of District of Paschim Burdwan without the prior permission of the learned trial Court.

Accordingly, CRM (M) 338 of 2026 is allowed.
