Writ petitioner received a MR dealership licence on compassionate ground. He was running the business. During the continuation of such business, her health condition deteriorated. Accordingly, he submits one application before the concerned authority, so that the his licence may be transferred in the name of her sister. The said representation (appearing page 26 of the writ petition) was not considered. Hence this writ petition. Having heard learned counsel for the parties, it appears that the representation was made to the concerned SCFS, who reqired consider the same. Learned counsel Mr. Dutta, appearing on behalf of the State authority submits that necessary direction may be made to the concerned respondent authority to dispose of representation according to law.

Having heard, learned counsel for the parties let the instant petition be disposed of with a direction to the Subdivision Controller, Food & Supply being respondent no.4 of this matter to dispose of the representation appearing at page 26 of the instant writ petition, within six weeks from the date of communication of this order by the petitioner.

The concerned SCFS shall dispose of the representation after giving a reasonable opportunity of being heard to the petitioner and shall communicate the decision to the petitioner within two weeks thereafter. I make it clear that this court has not gone into the merit of this matter, the concerned authority is at leave to dispose of representation according to law without being influenced by any observation of this Court.

Accordingly, this writ petition is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Subhendu Samanta, J.)
