Mr. Ramkrishna Bhattacharjee Mr. Kaushik Choudhury Ms.B. Khatun ..for the respdts.5&6 The writ petition has been filed alleging inaction on the part of the Officer-in-Charge, Raiganj Police Station. The allegation is that the police authorities have not taken adequate steps against the respondent nos. 5&6. A written complaint was lodged before the police authorities alleging that the respondent nos. 5&6 had tortured the petitioner and had forcefully driven the petitioner out of the premises situated near G.R.H.V. Boys' High School, Post Office, Debinagar, Police Station Raiganj, District Uttar Dinajpur. According to the petitioner, the respondent nos. 5&6 have tortured the petitioner from extortion of money. They wanted to take away the pensionery benefits, which the petitioner had received on her retirement as a school teacher.

Mr. Banerjee, learned senior standing counsel submits that Raiganj P.S. Case no. 190 of 2022 dated February 14, 2022 under Sections 323/506/34 of the

Indian Penal Code read with Section 24 of the Maintenance and Welfare Parents and Senior Citizen Act, 2007 has been initiated and an investigation is in progress.

Mr. Bhattacharjee, learned advocate appearing for the respondent nos. 5&6 submits that the question of driving out the mother forcefully, did not arise. That petitioner was trying to evict the respondent nos. 5&6 from the premises in question.

Having heard the learned advocates for the parties. This Court finds that the police authorities have already taken steps with regard to the complaint of the petitioner. Such investigation shall be reached to its logical conclusion within three months. The petitioner shall continue to reside in the premises in question without any fear.

The police authorities shall ensure that no breach of peace takes place and the petitioner can safely reside in the said premises.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
