Kausik (Rejected) CRM (NDPS) 230 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Jibantala Police Station Case No. 37 of 2025 dated 16.01.2025 under Sections 20(b)(ii)(c)/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioners submits that petitioners along with others have been foisted with the present criminal case for alleged recovery of 32.545 Kgs. of Ganja.

Learned advocate further submits that only one witness till date has been examined.

Learned advocate for the State opposes the prayer for bail so far as the quantum of seizure is concerned. Having regard to the period of detention, I direct the petitioners to renew his prayer for bail after the evidence of the seizure list witnesses are over.

At this stage, CRM (NDPS) 230 of 2026 is dismissed. Learned Special Court would give priority for evidence and/or deposition of the seizure list witnesses. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
