In re : An application under Section 482 of the Code of Criminal Procedure, 1973.

In the matter of:- Nilam Macdonald Mr. Arijit Ganguly Ms. Manisha Sharma .....for the State The present revisional application has been preferred challenging in the proceeding relating to Kalimpong Police Station Case No. 157 of 2013 dated 29.06.2013.

As none appears on behalf of the State, Mr. Arijit Ganguly, learned advocate, who ordinarily appears on behalf of the State, is directed to appear in this matter. His appointment may be regularized by the concerned authorities in due course.

I have perused the contention advanced in the revisional application and the First Information Report which has been registered for the purposes of investigation in relation to Sections 447, 448 and 506 of the Indian Penal Code and Section 3 (x) of the Schedule Caste and Schedule Tribe (Prevention of Atrocities) Act. Having regard to the nature of the allegations which have been made and prima facie the investigating officer arrived at the conclusion on the basis of the

evidence so collected, I am of the opinion that no interference is called for in respect of the present revisional application.

Accordingly, the revisional application being CRR 34 of 2014 is dismissed.

All pending applications, if any, in connection with the revisional application, are consequently disposed of.

Interim order, if any, is hereby vacated.

All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court.
