Mr. Masud Karim Mr. Ranjan Talapatra ..for the petitioner Mr. Monish Sen Ms. Oisani Mukherjee ..for respondent nos. 4 and 5 The petitioner has challenged a notice dated May 24, 2018 issued by the Principal of Maharajadhiraj Uday Chand Women's College, Burdwan, whereby she was asked to make an alternative residential accommodation within two months.
Learned advocate appearing for the college submits that the petitioner is in occupation of one room, which in fact is a part of the Chemistry laboratory of the college. She was allotted the said room on temporary basis only to meet her urgent need for residential accommodation.
He further submits that a residential accommodation for the college employees has already
been constructed and the petitioner can very well be accommodated in the said building.
Learned advocate appearing for the petitioner, however, submits that the petitioner along with some other employees was provided with her present residential accommodation by the college authority. He further submits that the petitioner is willing to vacate her present accommodation if she is allotted a residential unit in the newly constructed building. In view of the aforesaid stand of the respective parties, I do not see any justification to keep this writ petition pending.
Accordingly, this writ petition is disposed of with the following orders.
The college shall issue a letter in favour of the petitioner within a period of one week from date, allotting a residential unit in the newly constructed building within the college premises.
The petitioner shall vacate her present accommodation and shift herself to the new accommodation as allotted by the college within a period of two weeks from receipt of the letter of allotment issued by the college.
The petitioner shall clear all her dues towards the rent/licence fees against her present
accommodation within a period of two weeks from date.
With these aforesaid observations, WPA 1395 of 2019 is disposed of.
Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
