None appears for the Panchayat and the private respondents despite service.

Learned counsel for the petitioner submits that the private respondents have raised unauthorised construction on the land classified as suna without obtaining permission from the competent authority. A representation was submitted on behalf of the petitioner before the concerned authority on 7th July, 2025 which has not been considered. The petitioner prays for consideration of the said representation.

Upon consideration of the submission made on behalf of this parties, this Court directs the Pradhan Hizalna Gram Panchaya, being the 4th respondent herein, to consider and dispose of the representation submitted on behalf of the petitioner on 7th July, 2025 within two weeks from the date of communication of this order upon granting

reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law.

The decision taken by the authority shall be communicated to the parties within seven days thereafter. In the event such unauthorised construction is detected by the authority, necessary steps shall be taken in accordance with law.

The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
