This writ petition is thoroughly misconceived and does not have any public element at all.

The Court cannot decide on the policy decisions of the Government with regard to the functioning of the Transport Department of Government. Moreover, as correctly pointed out by Mr. Amal Kr. Sen, learned Additional Government Pleader that the State Government if it thinks fit, may appoint any number of officers in the service of the State Government to be the Deputy Secretaries and/or the Assistant Secretaries of the State Transport Authority and based on such power on 1st November, 2021, the Governor issued the order wherefrom it appears that Somnath Chakraborty was appointed as Transport Directorate, Head Quarter (Service will be utilized at STA).

On such consideration, we do not find any reason to entertain this application.

Accordingly, the writ petition stands dismissed.

However, there shall be no order as to costs. 5.
