This revisional application has been filed for expeditious disposal of the Title Suit No. 241 of 2002, pending before the learned Civil Judge (Senior Division), 1st Court at Barasat.

The plaintiff in the suit for declaration of title and recovery of possession has preferred this revisional application on the ground that the suit has not progressed.

It appears that some of the defendants have been recently added. Records do not reveal whether written statement has been filed by them or not. It also appears that an application under Section 151 of the CPC has been filed by the plaintiff.

Thus the revisional application is disposed of with a direction upon the learned court below to dispose of the pending applications upon affording opportunity to all concerned parties to contest the same within a period of two months from the next date fixed. Upon disposal of the pending applications the learned court below is directed to expedite the

disposal of the Title Suit keeping in mind the age of the suit. The suit should be disposed of within a year from date.

This court has not gone into the merits of the claims of the petitioner and the learned court below will proceed independently and in accordance with law.

Petitioner is directed to serve a copy of the revisional application along with the server copy of this order upon the opposite parties and/or their learned advocate appearing in the court below. The revisional application is disposed of. There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible subject to compliance of all usual formalities.
