And In the matter of: Kanai Mondal .... Petitioner Mr. Sayan Roy ...for the Petitioner This matter has been pending since 2007. On two occasions in 2007, when the matter was called on, on the prayer of the advocate for the petitioner, the matter was adjourned.

Subsequently, on June 28, 2021 the matter was called on by this Court and the petitioner sought time to take instruction. Once again, on July 8, 2021, the petitioner sought time. Today again, when the matter is called on, the petitioner seeks an adjournment. Having considered the conduct of the petitioner, I refuse to grant an adjournment. It is to be noted that no interim order is passed in this matter and the petitioner has not bothered to move this application even once for the past 14 years. In light of the same, this matter is dismissed as not pressed. The department concerned is directed to communicate this order, passed in Court today, to the Court below. The department shall ensure that acknowledgement of receipt of its communication is received. Report of compliance to be placed before this Court after three weeks.

The lower court is directed to expeditiously act in accordance with law.
