The petitioner is aggrieved by the fact that although Uluberia Police Station Case No. 05/2025 dated 03.01.2025 was registered for investigation under the relevant provisions of BNS, 2023, yet there has been no progress in the investigation. State has submitted a report which reflects that statements of the witnesses have been recorded and documents have been collected from the hospital authorities in respect of the injury sustained by the victim. Police authorities have also arrested one of the accused persons.

Having considered that the police authorities are taking steps, at this stage, I do not find any reason to interfere with the progress of the investigation. However, the learned Magistrate in seisin of the matter would after 45 days from the date of communication of this order, either on his

own or on the basis of any application made by the de facto complainant ascertain regarding progress of the investigation from the investigating officer of the case. A copy of the said report relating to progress be handed over to the learned advocate appearing for the de facto complainant by the learned Magistrate.

With the aforesaid observations, the writ petition being WPA 2619 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
