The Inspector-in-Charge, New Town Police Station, Bidhannagar Police Commissionerate dated 27th February, 2023 has filed a report and the same is taken on record.

It appears from the report that the petitioner's auto-rickshaw was on a hire purchase agreement with the Indusind Bank. The bank, after due notice to the Dum Dum Police Station, had repossessed the vehicle from the petitioner, who was unable to pay the monthly installments.

The petitioner, however, submits that along with the seizure of the vehicle certain sums of money were also stolen. A sum of Rs.1,500/- had been taken away from the driver of the vehicle.

In view of the above, the scope of the investigation appears to have been narrowed.

The New Town Police Station shall complete the investigation into FIR being New Town Police Station Case No.299/22 dated 31st December, 2022 within a period of one month from date. Attempt must be made to recover the stolen money. If such recovery is made,

the petitioner may apply before the Court below for return of such money in accordance with law.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.
