Affidavit-of-service filed on behalf of the petitioner is taken on record.

Petitioner was recommended for transfer vide memo dated 8th March, 2022 to one Nilganj Debendranath Jr. High School, North 24 Parganas. Subsequently, West Bengal Board of Secondary Education issued transfer order dated 11th March, 2022 and in terms of the said order petitioner made an effort to join the transferred post but she failed since Sub-Inspector of Schools, Barasat West Circle informed the concerned District Inspector of Schools (SE), North 24 Parganas that the school where petitioner was transferred is a zero enrolment school having no teacher and the same

was found to be non-functional.

Due to such intimation by the SubInspector, Barasat West Circle made to the concerned District Inspector of Schools (SE) petitioner could not join the transferred post which led the petitioner to make an application on the portal for re-recommendation.

The grievance of the petitioner is till date no steps have been taken by the concerned authority of the West Bengal Central School Service Commission to re-recommend the petitioner to another school.

Respondents are represented by learned advocates who have submitted jointly that due to suspension of Utsashree portal with effect from 29th September, 2022 steps could not be taken on application made by the petitioner seeking rerecommendation. Having considered the aforesaid facts, the present writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission being respondent no.3 to call the petitioner to appear before him and disclose available as well as suitable vacancies to the petitioner in order to re-recommend her.

If petitioner opts a vacancy amongst the

vacancies to be disclosed to her appropriate order shall be passed by the respondent no.3 immediately thereafter and same to be communicated to the petitioner.

Aforesaid exercise shall be completed by the respondent no.3 by six weeks from the date of communication of this order.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
