The writ petition is taken up for consideration in presence of the learned advocates representing the petitioners, respondent nos. 10 to 12 and State respondents.
In terms of the previous order dated 12th September, 2023 an affidavit has been filed wherefrom it appears that till date the Chief Medical Officer of Health, Hooghly, has not taken decision based on the recommendation made by Block Health and Family Welfare Samity. It has also been recorded in the order dated 12th September, 2023 that Block Health and Family Welfare Samity decided for cancellation of the panel in question for engagement of ASHA in Balarambati Gram Panchayat under Singur Block, District- Hooghly and the same was forwarded to the Chief Medical Officer of Health, Hooghly, for taking final decision.
In view of the affidavit affirmed by the Chief Medical Officer of Health, Hooghly, and in consideration of the recommendation of Block Health and Family Welfare Samity it would be apt to direct the Chief Medical Officer of Health, Hooghly, to take decision on the recommendation of Block Health and Family Welfare Samity expeditiously. Accordingly, the Chief Medical Officer of Health, Hooghly, being respondent no. 5 is directed to decide on the recommendation of the Samity within eight weeks from the date of communication of this order after granting opportunity of hearing to the petitioners and respondent nos. 10 to 12. The reasoned decision to be taken by the respondent no. 5 shall be communicated to the parties within one week thereafter.
With the aforesaid direction, the writ petition stands disposed of. Application, if any pending, also stands disposed of.
There shall be no order as to costs.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
