30.06.2022 Sl. No.179 srm W.P.A. No. 2327 of 2022 Kaberi Chowdhury & Anr.

Versus

The State of West Bengal & Ors.

Mr. Biswajit De, Mr. Debabrata Chakraborty ...for the Petitioners.

Ms. Sanghamitra Nandi, Mrs. Debarati Sen (Bose) ...for the State-respondents.

The police authorities have already initiated Kharagpur Police Station Case No.195 of 2022 dated April 9, 2022 under Sections 451/384/379/323/506/34 of the Indian Penal Code. The case is under investigation. The shop room of the petitioners has been opened. The police authorities are maintaining a vigil. It has been reported that so far no further complaint has been received from the petitioners with regard to subsequent threat and compulsory closure of the shop. The police report is taken on record.

As the allegation is of extortion and obstruction created by antisocial elements in the running of the petitioner's business, the investigation has to be conducted with more seriousness and promptitude.

Under such circumstances, the writ petition is disposed of with a direction upon the Inspector-in-Charge, Kharagpur Police

Station to conclude the investigation within a period of three months from date. The Superintendent of Police, Paschim Medinipur, shall closely monitor such investigation. The writ petition is, thus, disposed of.

There will be no order as to costs.

All parties are to act on the basis of the server copy of this order.
