AGP Ms. Reshma Chatterjee ...for the State Petitioners allege that the property of the petitioners has been utilised for the purpose of implementation of Bharatmala Project Phase-II at the instance of the National Highways Authority under the provision of the National Highways Act, 1956. Petitioners allege that the property of the petitioners has been utilised but no compensation has been paid to the petitioners till date. Petitioners submitted a representation dated December 29, 2025 before the District Magistrate and Collector, Purulia. Learned advocate appearing for the petitioners submits that no decision on such representation has been communicated to the petitioners till date.
Mr. De, learned AGP, appears and submits that the decision on the representation shall be
communicated to the petitioners within the time limit as may be stipulated by this Court.
In the light of the submissions made by the learned advocate appearing for the respective parties and without entering into the merits of the claim made in the said representation, this writ petition stands disposed of by directing the District Magistrate and Collector, Purulia, being the 2nd respondent herein, to consider the representation of the petitioner dated December 29, 2025 and to dispose of the same by passing a reasoned order in accordance with law after affording an opportunity of hearing to the petitioner or his authorized representative or any other interested party. The reasoned order shall be communicated to the petitioners as expeditiously as possible but positively within a period of eight weeks from the date of receipt of a server copy of this order along with a copy of the representation dated December 29, 2025.
