The revisional application appeared on 9th February, 2024 when an accommodation was sought for on behalf of the petitioner. Today, learned advocate has entered appearance and submits that there are case and counter case between the same parties, and an application under Section 125 CrPC has been initiated against the present petitioner by his wife. Having regard to the contentions so advanced on behalf of the petitioner, I am of the view that the same are question of facts to be considered in accordance with the trial of the proceedings being 248 of 2022 which is pending before the learned Judicial Magistrate, 3rd court, Chandannagar, Hooghly. No case is made out for interference by this court. With the aforesaid observations, the present revisional application being CRR 449 of 2024 is disposed of.
