AD 60 February 16, 2026 Ct. 28 SG CRM(A) 405 of 2026 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Manikchak P.S. Case No.857 of dated 25.11.2025 under Sections 85/108/80/3(5) of the BNS, 2023.

And In the matter of: Sadikul Momin @ Sadikul Alam @ Sadikul Alom ... petitioner Ms. Sujata Das ... for the petitioner Mr. Arindam Sen Ms. Pritha Paul ... for the State Learned counsel for the petitioner submits that the petitioner is the husband of the alleged victim. The victim had committed suicide within a year of marriage.

Learned counsel for the State strongly opposes the prayer for anticipatory bail and relies on the post-mortem report and the statements of witnesses including the statements of independent neighbours which support the prosecution case. Considering the above, the other incriminating materials available in the case diary and the alleged role ascribed to the present petitioner, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities. [ (Jay Sengupta, J.)
