Mr. Aniket Mitra ...... for the State Petitioner submits the victim had taken money from him and other co-accused persons. When they demanded return of the money, they were falsely implicated in the instant case. Learned lawyer for the State opposes the prayer for bail. We have considered the materials on record including the statement of victim recorded under Section 164 Cr.P.C. wherein he has not implicated the petitioner. Petitioner is known to the victim and therefore could not have been a person who allegedly impersonated himself as a police officer. In view of the aforesaid facts, we are inclined to grant anticipatory bail to the petitioner. Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.

Petitioner shall appear before the court below and pray for regular bail within four weeks from date.
