Petitioner and his wife are aged persons who complains that they have been harassed and heckled at the behest of the private respondent nos. 4 to 7. To that effect they intend to install CCTV cameras at the staircase and the main entrance.

Learned advocate appearing for the private respondents opposed the same and submits that the installation of the CCTV cameras would infringe upon the privacy of the private respondents and such issue was brought to the notice of the learned Civil Judge, Junior Division, 2nd Court, Barrackpore who is in siesin of T.S. 53/25.

Learned advocate for the State has submitted a report. Report reflects that there have been criminal cases registered at the behest of the parties. Police authorities have kept a vigil already over there in respect of the strained relationship existing between the petitioner and the private respondents.

So far as the issue relating to installation of CCTV cameras are concerned since the Civil Court is in siesin of the disputes petitioner would be at liberty to approach the Jurisdictional Civil Court for the purposes of installation of CCTV cameras. If the Civil Court is satisfied and passes any order in favour of the petitioner for installation of CCTV cameras which is resisted by the private respondents, in that case if a complaint is made, police authorities would respect and obey the Civil Court's order. But since such an order presently is not available and the rights of the parties are to be canvassed before the Civil Court, this Court at this stage will not deal with the same. However, since the petitioner is a senior citizen, in case he is faced with harassments which requires to be addressed and information is furnished with the police authorities, police authorities would immediately take steps for redressing the grievance of the petitioner.

Surveillance be kept by the police authorities to ensure that no breach of the peace or tranquility take place and/or any untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations WPA 2514 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
