Petitioner is granted liberty to approach the civil court with appropriate documents to show that he was in possession of the property complained of.

In case the petitioner has not been dispossessed from the property till date, the Officer-in-Charge of Chakdah Police Station will see that there is no further breach of peace till the civil court passes an order or direction.

Since the application under Section 145 Cr.P.C. has been dismissed, no interference is made by this court in respect of the proceedings which was preferred before the said executive magistrate.

With the aforesaid observations, CRR 365 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
