Jana Ms. Ujani Pal (Samanta) ... for the petitioner Mr. Amal Kumar Sen, AGP Mr. Lal Mohan Basu ... for the State The case of the petitioner is for transfer of permit of certain vehicles. The permits were in the name of the father of the petitioner. In the meantime the other legal heirs of the original petitioner, who has expired, have relinquished their claim in favour of the petitioner herein as to the holding of the said permits. He prays for hearing of his representation being Annexure P-7 at page 49 of the writ application which is pending with the concerned authority from 25th November, 2019. Learned AGP Mr. Sen fairly submits that the representation is required to be considered under Section 82(2) read with sub-Section (3).

I direct the respondent no. 3 to consider the representation after giving opportunity to the petitioner and all other legal heirs of the deceased permit holder. Such hearing is to be done by six weeks from the date of communication of the order and the decision thereon is to be communicated by two weeks thereafter. With the above directions, the matter is disposed of.
