Mr. Subhasis Chakraborty Mrs. Sushmita Kumari Singh Mr. Amit Chowdhury Mr. Aditya Mondal ... for the petitioner Mr. Sumit Ray ... for the WBSEDCL A new connection shall be granted in the premises in question upon compliance with all formalities, as the petitioner has been found to be in possession of the said premises along with his family.

The dispute between the petitioner and the respondent no.6 shall be decided by an appropriate forum. The connection shall not create any equity in favour of the petitioner and shall be subject to the outcome of any civil litigation between the parties.

The connection shall be granted within a month from the date of the petitioner's compliance with all formalities. If necessary, the respondent authorities shall be at liberty to request for police assistance and if such request

is made, then the State shall provide adequate police assistance. However, the expenses made by such distribution company shall be borne by the petitioner. The respondents are also at liberty to draw electric line through or over any common passage or public road.

With the above observations and directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act in terms of the copy of the order downloaded from the official website of this Court.
