129 24.02.2026 ss CRM (M) 347 of 2026 In the matter of : An application for bail under section 483 of BNSS, 2023 which is corresponding to section 439 of the Code of Criminal Procedure, 1973 filed in connection with Kaliganj P.S. Case No. 352 of 2021 dated 03.07.2021 under sections 302/34 of the Indian Penal Code.

Mr. Sabir Ahmed Mr. Dhiman Banerjee ... ... for the petitioners Mr. Anwar Hossain Ms. Dhanashree Biswas ... ... for the State Learned advocate appearing for the petitioners submits that the petitioners are better placed than other co-accused persons who have been granted bail.

Earlier orders granting bail reflect that on ground of delay other co-accused persons were granted bail. Present petitioners were arrested on the basis of warrant of execution of warrant of arrest and had been evading process of law. The charges have been framed as reflect on 7th December, 2025. Having considered that the petitioners had been evading process of law, at this stage I am not inclined to release the petitioners on bail until and unless trial progress substantially.

Thus, CRM (M) 347 of 2026 is dismissed.
