1. Report filed by the Sub-Divisional Officer, Malda Sadar in Court today be taken on record.

2. It appears therefrom that since after the last order dated 26th February, 2024 passed by this Court, the Sub-Divisional Officer, Malda Sadar called the petitioner for a hearing which she could not attend. It further appears that on earlier dates also the petitioner could not attend the hearing.

3. The subject matter of enquiry before the SubDivisional Officer, Malda Sadar is as to whether the Gond and Gour Classes are one and the same and whether the petitioner would be in the Scheduled Castes, Scheduled Tribes or any Reserved Category.

4. In those circumstances, this Court directs the SubDivisional Officer, Malda Sadar to obtain necessary clarification from the Joint Commissioner of Schools

for reservation from the Backward Class Department, Government of West Bengal and take appropriate decision with regard to the petitioner's status and communicate the same to the District Primary School Council, Malda and the petitioner within a period of one month from date.

5. The respondents shall thereupon act in accordance with law as regards the petitioner's appointment and communicate their decision to the petitioner forthwith.

6. With the aforesaid directions, the instant writ petition shall stand disposed of.

7. There will be no order as to costs.

8. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
