It has been informed by the Learned Advocate appearing for the petitioner that a sum of Rs.50,000/- has already been deposited with the jurisdictional Court and, to that effect, Mr. Rahman, do not raise any doubt. The O.P. No.1/wife would be at liberty to withdraw the amount deposited before the Learned 3rd Judicial Magistrate, Alipore, South 24 Parganas.

Since the Appellate Court is already, in seisin, of the matter, I direct the Learned Sessions Judge to dispose of the appeal, being Criminal Appeal No. 124 of 2022 by 30th of November, 2023.

The Opposite Parties would be at liberty to raise his grievance in respect of the arrears, if at all, before the Learned Sessions Court.

With the aforesaid observations, CRR 369 of 2023 is disposed of.
