For the State The complaint of the petitioner pertains to an electric pole installed at the premises of the petitioner. It is submitted by the petitioner that the respondent authorities have unlawfully and illegally installed the electric pole at the premises of the petitioner and the same is causing the petitioner severe hardship and annoyance.

Mr. Chaudhury appears on behalf of the Distribution Company and submits that the electric pole was installed at the subject premises as far back as in 2013 and the petitioner had raised no contemporaneous objection for a long period.

I have considered the submissions of the parties. I am of the view that in view of the grievance raised by the petitioner the matter be remanded to the District Magistrate, Murshidabad to consider the grievance of the petitioner.

The District Magistrate,

Murshidabad in hearing the grievance of the petitioner will give a notice on all the affected parties including the Distribution Company and the private respondents.

Liberty is granted to the petitioner to file a representation before the concerned District Magistrate within a period of two weeks from date and the District Magistrate will consider the representation of the petitioner within a period of two weeks from the date of receipt of such representation and after giving right of hearing to all the affected parties.

With the aforesaid directions, W.P.A.

2927 of 2021 is disposed of.

There shall be no order as to costs.

Photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
