Husband of the petitioner no. 1 and father of petitioner no. 2 was an employee of Eastern Coalfields Limited (for short, "ECL") who died-inharness on 26th August, 2007. Prayer is made on behalf of the petitioners to pay Monthly Monetary Cash Compensation (for short, "MMCC") and for appointment of petitioner no. 2 on compassionate ground.

Learned advocate representing respondents has submitted that petitioner no. 1 being wife of deceased employee is entitled to receive MMCC benefits as per extant Scheme. It is contended that application seeking benefits of MMCC was made in December, 2024 as a result whereof delay caused in extending such benefit. 3.

Having considered respective submissions made on behalf of the parties, concerned

authority of ECL is directed to release MMCC benefits to the petitioner no. 1 in terms of relevant Scheme by four weeks from date of communication of this order.

On the prayer made on behalf of the petitioners for providing employment on compassionate ground no application is found on record wherefrom it can be ascertained the date of submitting application seeking appointment on compassionate ground due to death of employee in harness. In absence of an application within prescribed time direction relating to appointment on compassionate ground ought not to be passed.

Writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
