In this writ petition the petitioners have prayed for a direction upon the respondent authorities to disburse the appropriate compensation in respect of the plots of the petitioners under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

Mr. Bandyopadhyay, learned Senior Government Advocate submits that the cause of action for filing the writ petition is that by way of forged deeds of conveyance being Deed No. 0914 of 2019 the property of the petitioners has been transferred by the 7th respondent in favour of the 8th respondent. He submits that such a dispute cannot be decided in the writ petition. After going through the averments made in the writ petition this Court finds that the cause of action for filing

the writ petition is that the petitioners have detected that forged deeds of conveyance has been executed thereby affecting the right of the petitioners in respect of the plot in question.

As to whether the deeds of conveyance is forged or not and the issue of title in respect of an immovable property cannot be decided in a writ petition. After some argument the learned advocate appearing for the petitioners prays for leave to withdraw this writ petition with liberty to approach the appropriate forum in accordance with law.

In the light of the prayer made by the learned advocate for the petitioners, WPA 2636 of 2026 stands dismissed as withdrawn with liberty as sought for by the learned advocate for the petitioners.
