Petitioner approached this court as the police authorities did not take any steps pursuant to the FIR having been registered on or about 17.11.2022. Records reflect that the petitioner filed an application under section 156(3) of the Cr.P.C. before the learned ACJM, Bongaon and consequent to which Gaighata PS Case No. 1080/2022 was registered for investigation.

As none appears on behalf of the State, Mr.

Amartya Pal, learned advocate who ordinarily appears on behalf of the State is directed to represent the State. His appearance may be regularized by the concerned authorities.

Having regard to the time period which has passed in the meantime which is more than two and a half years, I am of the view that if similar inconveniences are faced regarding the progress of

the investigation, petitioner would be at liberty to submit a fresh representation before the Superior Officer of the police, particularly the SDPO/DSP/Additional SP in charge of Gaighata Police Station.

With the aforesaid observations WPA 2464 of 2023 is disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
