No. 29 CHC Rejected C.R.M.(A) 379 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Baishnabnagar Police Station Case No. 564/2023 dated 21.08.2023 under Sections 341/323/326/307/34 of the Indian Penal Code and added Section 306 of the Indian Penal Code.

And In the matter of : Mohan Mandal ...... petitioner Mr. Arup Kumar Bhowmick ....for the petitioner Mr. Anand Keshari ....for the State Petitioner prays for anticipatory bail.

Victim expired after suffering blunt trauma on the head and was removed to the hospital while alive. The First Information Report of the victim states that, victim suffered blunt trauma on his head. It also speaks of poisoning. Victim died subsequently.

Post Mortem Report suggests that death was due to the effects of poisoning.

Place of occurrence of the consumption of poison and the assault is the residence of the petitioner before us. Apparently, the victim and the daughter of the petitioner were in a relationship. Role played by the petitioner in the incident

requires investigation since, the injury report of the victim shows the injury on the victim prior to his death. Consequently, we are unable to grant anticipatory bail to the petitioner.

This application for anticipatory bail is, thus, rejected. CRM(A) 379 of 2024 is disposed of.
