18.05.2021 sdas allowed C.R.M. No. 1139 of 2021 (via video conference) In Re.: An application under Section 438 of the Code of Criminal Procedure in connection with Tehatta Police Station Case No. 500 of 2020 dated 17.11.2020 under Sections 341/325/326/307/506 of the Indian Penal Code.

And In Re: Kisore Mondal ......... petitioner Mr. Asraf Mandal ...for the petitioner Mr. Saibal Bapuli, learned APP Ms. Faria Hossain Mr. Subrato Roy .... for the State Considering the materials produced before this Court and the injury report and the extent of involvement of the petitioner in the commission of offence, we are of the opinion that custodial interrogation of the petitioner is not necessary in the instant case.

Accordingly, we direct that in the event of arrest the petitioner namely Kisore Mondal shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on

further condition that the petitioner shall meet the investigating officer once in a week until further orders. With the aforesaid observations, this application for anticipatory bail is, thus, allowed.
