Criminal Revisional Jurisdiction CRR 52 of 2016 In re. An application under Section 401 read with Section 482 of the Cr.P.C.

In the matter of: Monirul Islam ... petitioner The subject-matter of challenge in the present revisional application relates to the judgment and order dated 14th August, 2015 passed by the learned Judge (Special) 2nd Court, Malda, in connection with P.O.C.S.O. No.133 of 2015 arising out of Ratua Police Station Case No.782 of 2013 dated 09.12.2013 under Sections 506/417/376(2)(i) of the Indian Penal Code read with Section 4 of the POCSO Act, 2012. Having regard to the prayers so advanced before this Court in respect of warrant of arrest issued, I am of the opinion that more than 7 years have passed and there is changed circumstances which do not call for interference. As none appeared on behalf of the State, Mr. Arijit Ganguly along with his junior Ms. Manisha Sharma who ordinarily appear on behalf of the State, is directed to appear in this matter on behalf of the State. Let their appearance be regularised by the concerned authorities.

With the observations made above, no interference is called for.

Accordingly, CRR 52 of 2016 is dismissed and connected application if any is consequently dismissed.

All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this Court.
