1. Affidavit of service filed in Court today is taken on record.

2. The petitioner prays for a direction upon the SubDivisional Officer to take steps in terms of the direction passed by the Court on 10th January, 2020 in W.P. No. 24655(W) of 2018 with CAN 11173 of 2019 in the matter of Krishnapada Sardar and another Vs. The State of West Bengal and others.

3. Learned advocate representing the State respondents has obtained instruction from the Sub-Divisional Officer wherefrom it appears that, the Sub-Divisional Officer has already forwarded the papers of the case to the Chair Person, State Scrutiny Committee and the Secretary, Backward Classes Welfare Department by a communicating memo dated 14th February, 2020.

4. Learned advocate for the State also submits that, as on date, the Sub-Divisional Officer is the competent authority to adjudicate and dispose of the issue.

5. As it appears that, the cause of action for filing the instant writ petition arose prior to the coming into effect of the West Bengal Scheduled Castes and Scheduled Tribes (Identification) (Amendment) Act, 2022 and the order passed by the Hon'ble Single Judge on 10th January, 2020 stood affirmed by the Hon'ble Division Bench on 3rd August, 2023, accordingly, the amendment Act will not be applicable in the instant writ petition.

6. The direction passed by the Hon'ble Court on 10th January, 2020 shall be complied with in the manner as prescribed in the said order if not complied in the meantime.

7. Steps shall be taken in the matter at the earliest, but positively within a period of twelve weeks from the date of communication of this order.

8. The writ petition stands disposed of.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
