The petitioner is aggrieved by the fact that although she complained that there was a promise to marry but the relevant Sections of the BNS, 2023 have not been incorporated in the FIR and the accused persons are taking advantage of the same. Further in spite of informing the police authority, they have acted in the delayed manner and in spite of unknown persons threatening the petitioner and the police being informed no steps have been taken. State has submitted a report. The report reflects that the police authority on receipt of the information registered Shantipur Police Station 65 of 2025 under the relevant provisions of Section 126 (2)/318(2)/115(2)/74/351(2) (3)/3(5) of the BNS. Report also reflects regarding the steps taken by the
Investigating Officer in course of progress of the investigation. However, the report do not reflect that any statement of the victim who has complained was recorded by a Judicial Magistrate, although the same is part of the investigation. It would be the wisdom of the Investigation Officer to cross check whether the same is required in course of the investigation or not. The Investigating Officer would further cross check as to whether the victim is being threatened at the behest of the unknown miscreants.
If there is any complaint, necessary protection be afforded or if any application is made to the Learned Magistrate, necessary protection be extended under the witness protection scheme, 2018.
With the above observation WPA 2696 of 2025 is disposed of.
