Mr. Amal Kumar Saha ... ... for the petitioner The petitioner has challenged the order dated 4th December, 2021, wherein the learned appellate court being the learned Additional Sessions Judge, 1st Court, Hooghly Sadar, in Criminal Appeal No.47 of 2013, dismissed the application under Section 391 of the Criminal Procedure Code of the appellant. The appeal is pending for more than ten years and the order under challenge is of December 2021. Records reflect that the application under Section 5 of Limitation Act was affirmed on 31st January, 2024. There has been unnecessary delay by keeping the issue pending. At this belated stage, I am not inclined to grant any leniency to the present appellant.

Accordingly, the application under Section 5 of the Limitation Act being CRAN 1 of 2024 filed in connection with CRR 457 of 2024 is dismissed.

The learned appellate court is directed to proceed with the appeal and take the same to its logical conclusion within a reasonable period of time preferably within 30 days from the date of communication of this order.

Thus, CRR 457 of 2024 is disposed of.

All parties are to act on the basis of the server copy of the order.
