Learned counsel for the petitioner submits for enlargement of the petitioner on bail on any condition in connection with Santipur Police Station Case under Section 363/365 of the IPC read with Section 6 of Protection of Children from Sexual Offences Act. It is submitted that the petitioner is in custody for last one year, eleven months and 19 days. The charge sheet has been submitted and charge has also been framed and the schedule of the trial has been fixed on and from 20.6.2021.

Learned Counsel for the State pressed in service the Case Diary and invites our attention to the statement of the victim girl aged 13 years recorded under Section 164 of the Cr.P.C. by the learned Judicial Magistrate.

Having regard to the statement of the victim girl under Section 164 Cr.P.C. and other statements of the witnesses under Section 161

Cr.P.C. and considering the nature and gravity of the offence, the prayer for bail is refused.

Hence, the prayer for bail stands rejected.

Accordingly, C.R.M. 1143 of 2021 is disposed of. Learned Special Judge under POCSO Act will take steps for expeditious trial of this case on the scheduled date. (Aniruddha Roy, J.) (Shivakant Prasad, J.)
