Mr. S.P. Mukherjee, learned senior counsel appearing on behalf of the appellants, submits that the sole appellant and the sole respondent have both died. He submits that the heirs and legal representatives of the deceased appellant are not willing to proceed with the present appeal and he files the written instructions of the heirs and legal representatives of the deceased appellant to the said effect, which is taken on record.

Accordingly, SA 449 of 2001 and the connected applications, if pending, are dismissed.
