The petitioner is aggrieved by the minimum qualification which has been advertised for selection ( direct recruitment) to the post of Homeopathic Medical Officer under the West Bengal Homeopathic Health Services under the Department of Health and Family Welfare, Government of West Bengal.

As it appears that the appointment is to be made under the Government of West Bengal, this Court under Article 226 of the Constitution of India will not have the jurisdiction to decide the issue, at this stage. The writ petition is accordingly dismissed on the ground of lack of jurisdiction.

The petitioner will be at liberty to approach the appropriate forum, in accordance with law, if so advised. Urgent photostat certified copy of this order, if applied for, be given to the parties upon completion of usual legal formalities.
