Petitioner approached this Court as her daughter was kidnapped and to that effect, information was furnished. However, the minor girl was never recovered.

Today, a report has been submitted on behalf of the State which reflects that on 15.02.2025 the minor girl was recovered. Her statement was recorded both under Section 180 of BNSS and Section 183 of BNSS. Apart from Section 137(2) of BNS, 2023, Section 64 of BNS and Section 6 of the POCSO Act along with Section 9 of the Prohibition of Child Marriage Act, 2006 have been incorporated. The investigating agency has put in efforts for arresting the accused persons.

Since the primary grievance of the petitioner for preferring the writ petition has been sub-served relating to recovery of the minor girl, further

pendency of the writ petition is unwarranted. So far as the other issues are concerned, petitioner will ventilate her grievance before the learned special court in seisin of Shyampur Police Station Case No.01 of 2025.

With the aforesaid observations, WPA 2549 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing on behalf of the petitioner.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
