Mr. Arka Chakraborty ...For the Petitioner Mr. Sudip Kumar ...For the State Ms. Karabi Roy ...For the De facto There is a previous police complaint at the behest of the mother of the petitioner against the husband of the de facto complainant, implicating such accused in cyber crime. Thereafter, the present police complaint was lodged.

The State and the de facto complainant are represented. There is an issue of false implication. The de facto complainant refused to undergo any medical examination.

In such circumstances, we grant anticipatory bail to the petitioner.

The prayer for anticipatory bail is, thus, allowed. Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner shall meet the Investigating Officer as and when called for till completion of the investigation.
