Mr. Soumen Kumar Dutta, counsel appearing on behalf of the petitioner, prays leave to add the Commissioner of School Education as a party to this proceeding. Such leave is granted.

Petitioner is directed to add the Commissioner of School Education as a party respondent to this proceeding and serve an amended copy of the writ petition upon the added respondent within two days from date.

Mr. Dutta further submits that he has no grievance against the West Bengal School Service Commission. Accordingly, prayer made in the writ petition is not being pressed by him.

He, however, submits that since an application had been filed by him now before the Commissioner of School Education that has been incorporated by way of an supplementary affidavit which has been filed in Court today.

Copies of the said affidavit be served upon Dr. Patra and Mr. Basu Mallick in course of the day.

In light of the above, I direct the Commissioner of School Education, the added respondent to look into the application filed by the petitioner and pass a reasoned order within a period of twelve weeks from date.

With these above observations and directions, this writ petition stands disposed of.

Since, no affidavit-in-opposition has been called for the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
