Mr. Ramesh Dhava Mr. Mousumi Chakrbaorty .....For the appellant Ms. Sonal Sinha Ms. Ashmita Chakraborty ...for the State Affidavit of service filed on behalf of the petitioner is taken on record.

Mr. Dhara, learned counsel appearing on behalf of the petitioner fairly submits that after filing of the instant writ petition the authority concerned has issued a notice for inspection at the proposed shop-cumgodown of the petitioner. He submits that the concerned authority was preceding delay in filling the vacancy of the impugned vacancy notification for which the instant writ petition was filed.

He submits that as the authority concerned has taken necessary steps, hence it is not necessary to proceed with the writ petition.

Considering the submission of Mr. Dhara and also considering the submission of Ms. chakraborty, appearing on behalf of the State authority, it appears

that State authority has already proceeded to fill up the vacancy. Accordingly, there is no necessity to proceed further with the writ petition.

Let the instant writ petition is disposed of with a direction to the concerned authority to proceed with the impugned vacancy notification according to the law. [Subhendu Samanta, J]
