1. Let affidavit of service, as filed in Court, be kept on record.

2. The petitioners are all affiliated colleges to the Baba Saheb Ambedkar Education University.

The petitioners, after having completed the process of admission, have found that an aggregate of 263 seats are lying vacant.

3. Since the process was advised to be completed by November 14, 2025, the same has been completed without filling up the afore-stated seats.

4. Mr. Mukherjee, learned Senior Advocate appearing for the State, submits on instructions that the State has no objection to consider and extend the time to enable the colleges affiliated to the University, as afore-stated, to fill up the seats upon following due

process of law.

5. In view of the fair stand taken by the parties, I direct the University to submit an application seeking extension of time with the respondent no. 1 by February 20, 2026. The respondent no. 1 or any person authorized by it, not below the rank of Special Secretary in the department of Higher Education, Government of West Bengal, is directed to consider such representation and extend the time, upon considering all other requisite factors by an appropriate period. as it may deem fit.

6. Needless to mention, such extension will not be a precedent and also not create any disruption to the ongoing academic session of each of the colleges.

7. The students, so admitted, pursuant to the extension will be given additional and extra classes by the colleges in terms of the NCTE guidelines and fulfil all requisites to enable such students to sit for the semester examination.

8. With these directions, the writ petition is disposed of.

9. There shall, however, be no order as to costs.

10. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
