Petitioner has prayed for expeditious disposal of NDPS Case No. 20 of 2023 pending before the learned Additional District and Sessions Judge, 6th court, Barasat, North 24 Parganas. Learned advocate for the petitioner submits that the petitioner is in custody since 26th February, 2023, more than one year has passed. A report as such was called for. Learned advocate for the NCB has submitted the report. The background of this case reflects that two accused persons are involved in this case and one of the accused person is still absconding while the petitioner is detained in custody. The report which has been submitted reflects that the case before the learned trial court has been split up and the next date has been fixed on 22nd March, 2024 for supply of copies. In view of the steps taken by the learned trial court, I direct that the learned special court in seisin of the matter to consider the
charges after supply of copies within a month thereafter and on and from the month of May, 2024, the learned trial court would fix a schedule consisting of three dates and fix such schedule once in every two months so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. In case any of the witness is not appearing, the learned trial court would inform the Inspector of NCB namely, Amal Kumar Sadhukhan, who would ensure regarding the availability of the witnesses before the learned special court or in the alternative submit a report in respect of nonavailability of the witness for reasons beyond their control. Learned trial court will not accept any other reasons for absence of the witnesses concerned.
The Public Prosecutor appearing in the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses concerned. All efforts be taken by the stake-holders to cooperate with the trial court so that the trial is concluded within a reasonable period of time. With the aforesaid observations, the present revisional application being CRR 463 of 2024 is disposed of. Pending applications, if any, are consequently disposed of.
