Petitioner was aggrieved by the investigation of Gariahat Police Station Case No.285 dated 27.12.2023 under the relevant provisions of the Indian Penal Code. During the pendency of the writ petition the investigation of Gariahat Police Station Case No.285 dated 27.12.2023 has been taken over by the Detective Department, Lalbazar and has been assigned to the Officer-in-Charge of Anti Cheating Section, Detective Department, Lalbazar.

In view of the investigation having been already handed over to the Specialized Agency, I am

of the opinion that at this stage, the prayer so advanced for being frustrated with the progress of the investigation which is the subject matter of the writ petition has been addressed. The new Investigating Officer would oversee all aspects of the case and take the investigation to its logical conclusion.

With the aforesaid observations, WPA 2598 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

A copy of the report dated February 9, 2025 be handed over to learned advocate for the petitioner. Needless to state that since no affidavit has been called for, the allegations against the State and the private respondents are deemed not have been admitted.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
